Option 1 - We keep it the same as last year.
If you were over the cap, you could resign your own players up to the max, and then use your MLE / LLE in attempt to sign new players. If you were under, you had to resign your own free agents before bidding on others. If you were still under the cap, you could use that money to sign new free agents, otherwise you had to use the MLE or LLE. In the case of multiple teams chasing one person, here is a solution I came up with.. it benefits winning teams, which is a reason you should not tank or try to ruin your team. For each win, you get an extra minute to make a bid in attempt to steal a free agent. For example, say Detroit Pistons and Utah Jazz are both under the cap by $15 million and are targeting the same player. Utah Jazz had 21 wins last season, and Detroit had 63, a difference of 42 minutes. Say as soon as 12:00 rolled around, Utah made a $15 million offer to Shaq, Detroit would have 42 minutes to make the same offer and steal the free agent, otherwise Utah's offer stands (as long as the owner, in this case Cleveland Cavaliers, doesn't offer $15 million for 6 years rather than 5.) Understand?
Option 2 - Only resigning RFAs
If you are over the cap, you can basically kiss your Free Agents goodbye, unless they are all restricted, or are worth less than the MLE. This assures free agent flow, but can hurt some teams pretty badly. If you are still under the cap after you resign your RFA's, you can attempt to resign yours or others free agents.
Option 3 - All RFA's and 1 UFA
This also assures free agent flow, you can resign all of your restricted free agents - and one of your unrestricted free agents. Cleveland in this case can resign Prince and Shaq. You can hang on to one of your free agents and attempt to resign the other for the MLE. If you have 2 top free agents, and you are able to sign 1 to go over the cap and the other at the MLE, you can't sign anyone else of value (LLE for most people, minimum contracts to others)
Option 4 - Either All RFAs or 1 UFA
Another method of ensuring free agent flow, you have the choice in this one of your precious restricted and unrestricted free agents. You have to make a serious decision here, is that unrestricted free agent more important to you than all your restricted ones?

A good point was brought up to me - I'm sure the rest of the NBA would have loved it if the Dallas Mavericks were not allowed to resign Jason Terry because they are over the cap, or if the year after that they have to pick between Josh Howard or Dirk Nowitzki, because Howard will be restricted and Dirk will be able to opt out, or if Detroit wasn't allowed to offer Ben Wallace anything because they resigned Restricted Free Agent Tayshaun Prince to a new contract.
